WALL TOWNSHIP — The New Jersey Office of the State Comptroller [OSC] has issued a report that determined that Wall Township was among 57 municipalities with policies violating reform laws on when sick-leave payments are made to township employees.
OSC’s review found that, to a startling degree, the laws have been ignored, sidestepped and undermined in almost all of the municipalities reviewed. OSC determined that 57 of the 60 municipalities failed to fully comply with the laws, leading to both actual waste and abuse of public funds, as well as substantial future liabilities for these municipalities
OSC’s survey found that Wall Township ordinances 33-6 and 33-7, last amended in 2016, violate state laws that limit when sick leave payments may be made, how much can be paid and to which employees.
Jeff Bertrand, township administrator, said he is confident that the necessary revisions will be made sometime next month.
“The 57 municipalities are required to submit plans to correct their policies that violate the law on sick leave payments by September 30, 2022,” stated Kevin D. Walsh, Acting State Comptroller. “The municipalities are expected to show how they will comply with state law by that date and to correct past problems. We are required to monitor our recommendations and will consider sharing information with the public about what the municipalities have decided as appropriate.”
According to the OSC report, the text of Wall Township’s Ordinances 33-6 and 33-7 do not comply with the 2007 law [N.J.S.A. 40A:9-10.2] concerning sick leave because it allows payment of accrued sick leave at a time other than retirement for covered employees.
